1. Acceptance of Terms
By downloading, installing, accessing, or using the ScanYum mobile application or the ScanYum website (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.
You represent and warrant that:
- You are at least thirteen (13) years of age, or the minimum age required in your jurisdiction to consent to the use of the Service;
- If you are under the age of eighteen (18) (or the age of majority in your jurisdiction), you have obtained the consent of a parent or legal guardian to use the Service;
- You have the legal capacity and authority to enter into a binding agreement; and
- Your use of the Service does not violate any applicable law or regulation.
2. Definitions
For purposes of these Terms, the following definitions apply:
- "ScanYum," "we," "us," or "our" refers to the operators of the ScanYum application and website.
- "Service" means the ScanYum mobile application, the ScanYum website, and all related features, tools, content, and services provided by ScanYum.
- "App" means the ScanYum mobile application available for download on the Apple App Store for iOS devices.
- "User," "you," or "your" refers to any individual who accesses or uses the Service.
- "Content" means all text, graphics, images, translations, data, software, and other materials displayed on or available through the Service.
- "User Content" means any content, including but not limited to photographs, images, text, and feedback, that you submit, upload, or transmit to or through the Service.
- "Scan Data" means the images of menus, labels, or other materials that you capture or upload using the Service, together with any resulting translations, currency conversions, or other processed output.
- "Scan Modes" means the specialized scanning categories available within the App, including but not limited to Beer Mode, Wine Mode, and Cocktail Mode.
- "Subscription" means a paid, automatically renewing access plan that unlocks premium features and functionality within the Service for a specified billing period (e.g., weekly, monthly, or annual).
3. Account Registration
Certain features of the Service may require you to create an account. When you register for an account, you agree to:
- Provide accurate, current, and complete information during the registration process;
- Maintain and promptly update your account information to keep it accurate, current, and complete;
- Maintain the confidentiality of your account credentials and accept responsibility for all activities that occur under your account;
- Notify us immediately of any unauthorized use of your account or any other breach of security; and
- Accept that ScanYum shall not be liable for any loss or damage arising from your failure to comply with the foregoing obligations.
We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, including if we reasonably believe that you have violated these Terms.
4. The Service
ScanYum is a mobile application designed to help users scan, translate, and understand menus and food-related content while traveling or dining. The Service currently includes the following features:
- Menu Scanning: Use your device's camera or photo library to capture images of menus, labels, or other food-related materials for translation and analysis.
- Translation: Automatic translation of scanned text into your preferred language, supporting over 170 languages.
- Currency Conversion: Real-time price conversion across 56 currencies to help you understand costs in your home currency.
- Scan Modes: Specialized modes — including Beer Mode, Wine Mode, and Cocktail Mode — that provide tailored information and tasting notes for beverages.
- Scan History: A record of your previous scans, stored locally on your device and/or in your account, for convenient reference.
The App is currently available exclusively on iOS devices through the Apple App Store. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice.
5. License Grant
Subject to your compliance with these Terms, ScanYum grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download, install, and use the App on a single iOS device that you own or control;
- Access and use the Service for your personal, non-commercial purposes only.
This license does not include the right to sublicense, resell, distribute, or make the Service available to third parties. This license is effective until terminated in accordance with these Terms. All rights not expressly granted herein are reserved by ScanYum.
6. Restrictions on Use
You agree not to, and shall not permit any third party to:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Service or any part thereof;
- Use any automated system, including but not limited to robots, spiders, scrapers, or offline readers, to access the Service for any purpose;
- Use the Service for any commercial purpose, including reselling translations, scan results, or any other output of the Service;
- Interfere with, disrupt, or create an undue burden on the Service or the networks or servers connected to the Service;
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service;
- Use the Service to transmit any unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;
- Use the Service to scan or process materials that infringe upon the intellectual property rights of any third party;
- Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service;
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Service; or
- Use the Service in violation of any applicable local, state, national, or international law or regulation.
7. User Content & Scan Data
You retain ownership of any User Content and Scan Data that you submit to the Service. By submitting User Content or Scan Data, you grant ScanYum a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process, adapt, and display such content solely for the purposes of:
- Operating and providing the Service to you, including performing translations, currency conversions, and generating scan results;
- Improving, developing, and enhancing the Service and its features; and
- Complying with applicable legal obligations.
You represent and warrant that you have all necessary rights and permissions to submit any User Content and Scan Data, and that such content does not infringe upon the rights of any third party.
Scan Data may be processed by third-party services (such as translation and optical character recognition providers) in order to deliver the Service. We may retain Scan Data in anonymized or aggregated form for the purpose of improving the Service. For further details on how we handle your data, please refer to our Privacy Policy.
8. Fees & Purchases
ScanYum operates on a freemium model. The core features of the Service are available free of charge, while certain premium features and additional functionality may be offered through in-app purchases or subscriptions.
- All in-app purchases and subscriptions are processed through the Apple App Store and are subject to Apple's terms and conditions, including Apple's refund and cancellation policies.
- Prices for premium features are displayed within the App at the time of purchase and are denominated in your local currency as determined by Apple.
- Subscriptions automatically renew unless cancelled at least twenty-four (24) hours before the end of the current billing period. You may manage and cancel subscriptions through your Apple ID account settings.
- We reserve the right to change the pricing of any premium features or subscriptions at any time. Price changes will not affect active subscription periods already paid for.
- ScanYum does not process payments directly. For billing disputes, refund requests, or payment-related inquiries, please contact Apple Support or submit a request through Apple's Report a Problem page.
Free Trials & Introductory Offers
ScanYum may offer free trial periods or introductory pricing for Subscriptions. The following terms apply:
- A free trial provides temporary access to premium features at no charge for a limited period as specified at the time of enrollment.
- Unless you cancel before the end of the free trial period, your Subscription will automatically convert to a paid Subscription, and you will be charged the applicable Subscription fee. You may cancel during the trial at any time through your Apple ID account settings.
- Introductory offers (such as reduced pricing for the first billing period) are available only to eligible users and are subject to the terms displayed at the time of purchase.
- Free trial and introductory offer eligibility is determined by Apple and may be limited to one trial per Apple ID.
Offer Codes & Promotional Offers
ScanYum may issue promotional codes or App Store offer codes that grant access to premium features or discounted Subscriptions. Such codes are subject to separate terms and conditions, including limitations on region, duration, and number of redemptions. Offer codes may not be sold, transferred, or exchanged for cash value.
Billing Grace Period
If automatic renewal of your Subscription fails due to a payment issue (such as an expired credit card), Apple may provide a billing grace period during which your access to premium features may be temporarily maintained while the payment issue is resolved. If the payment cannot be recovered within the grace period, your access to premium features will be suspended. You are responsible for ensuring that your payment information is current.
Chargebacks
If you initiate a chargeback or payment dispute with your bank or payment provider regarding a Subscription or in-app purchase, we reserve the right to suspend or revoke your access to premium features until the dispute is resolved. We encourage you to contact us via our contact page or use Apple's Report a Problem process before initiating a chargeback.
Price Changes
We may change Subscription pricing from time to time. When prices increase, Apple will notify active subscribers in advance through the App Store, and where required by applicable law or App Store policy, your consent may be required before the new price takes effect. If you do not agree to a price change, you may cancel your Subscription before the new price applies. Price decreases or other adjustments may take effect without additional notice.
9. Credits and Rollover Policy
Unused credits from your current billing period may roll over to the next period for all paid subscription plans. Free plan credits do not roll over.
Rolled-over credits are subject to a maximum balance cap equal to your plan's per-period credit allowance (1×). For example, a Weekly Lite plan with 5,000 credits per period may accumulate up to 5,000 bonus credits from prior periods.
Rolled-over credits are consumed first. If your accumulated credits exceed the cap for your plan, the excess will not carry over.
Upon downgrade to a plan with a lower cap, your rollover balance will be adjusted to the new plan's maximum. Upon cancellation or expiration of your subscription, all rollover credits are forfeited.
Credits have no cash value and are non-transferable.
10. Intellectual Property
The Service and all of its contents, features, and functionality — including but not limited to all software, code, designs, text, graphics, logos, icons, images, audio, video, data compilations, and the selection and arrangement thereof — are the exclusive property of ScanYum or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The ScanYum name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ScanYum. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans appearing on the Service are the trademarks of their respective owners.
Nothing in these Terms shall be construed as transferring any rights, title, or interest in the Service or its intellectual property to you or any third party.
11. Third-Party Services
The Service relies on third-party services, APIs, and platforms to deliver certain features, including but not limited to:
- Translation and optical character recognition (OCR) service providers;
- Currency exchange rate data providers;
- Apple Inc. and the Apple App Store for distribution, payment processing, and push notifications; and
- Cloud hosting and infrastructure providers.
ScanYum is not responsible for the availability, accuracy, or reliability of any third-party services. We make no representations or warranties regarding the performance or uptime of third-party services, and we shall not be liable for any loss, damage, or inconvenience caused by any failure, interruption, or error in such third-party services.
Your use of third-party services may be subject to the terms and conditions and privacy policies of those third parties. We encourage you to review the terms of any third-party services you interact with through the Service.
12. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, SCANYUM DOES NOT WARRANT OR REPRESENT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
- THE TRANSLATIONS PROVIDED BY THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE;
- THE CURRENCY CONVERSIONS WILL REFLECT CURRENT OR ACCURATE EXCHANGE RATES;
- ANY ALLERGEN, INGREDIENT, NUTRITIONAL, OR DIETARY INFORMATION DERIVED FROM SCANNED CONTENT WILL BE ACCURATE OR COMPLETE; OR
- ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED.
THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL DIETARY, MEDICAL, OR NUTRITIONAL ADVICE. YOU SHOULD ALWAYS VERIFY ALLERGEN INFORMATION, INGREDIENT LISTS, AND DIETARY RESTRICTIONS DIRECTLY WITH RESTAURANT STAFF OR OTHER QUALIFIED PROFESSIONALS. RELIANCE ON ANY INFORMATION PROVIDED BY THE SERVICE IS SOLELY AT YOUR OWN RISK.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCANYUM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF SCANYUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF SCANYUM FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) FIFTY U.S. DOLLARS ($50.00); OR (B) THE TOTAL AMOUNT OF FEES PAID BY YOU TO SCANYUM DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations set forth above shall apply to the fullest extent permitted by applicable law.
14. Indemnification
You agree to indemnify, defend, and hold harmless ScanYum, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of or access to the Service;
- Your violation of these Terms;
- Your violation of any rights of any third party, including intellectual property rights;
- Any User Content or Scan Data you submit to the Service; or
- Your violation of any applicable law, rule, or regulation.
This indemnification obligation shall survive the termination of these Terms and your use of the Service.
15. Termination
These Terms are effective until terminated. We may, in our sole discretion, at any time and for any or no reason, suspend or terminate your access to the Service, your account, or any part thereof, with or without prior notice.
- You may terminate your use of the Service at any time by deleting the App from your device and discontinuing all use of the Service.
- Upon termination, your license to use the Service shall immediately cease, and you must destroy all copies of the App in your possession.
- Termination shall not relieve you of any obligations incurred prior to termination, including any payment obligations for in-app purchases already made.
- Data Retention. Upon termination of your account or expiration of your Subscription, we may retain your account data and Scan Data for a limited period (not to exceed ninety (90) days) to allow you to export your data. After this period, your data will be deleted in accordance with our Privacy Policy, except where retention is required by applicable law, necessary for the resolution of disputes, or needed for the enforcement of these Terms.
- The following sections shall survive termination of these Terms: Definitions, User Content & Scan Data, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution & Arbitration, Governing Law, Severability, International Users & Consumer Rights, Apple App Store Provisions, and Entire Agreement.
16. Dispute Resolution & Arbitration
Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court.
- Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact us via our contact page and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved within thirty (30) days of the initial notice, either party may proceed as set forth below.
- Binding Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, that is not resolved through informal resolution shall be finally settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator, and the seat of arbitration shall be Wilmington, Delaware, USA. The language of the arbitration shall be English. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
- Class Action Waiver. YOU AND SCANYUM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR SHALL NOT HAVE THE AUTHORITY TO CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. YOU ACKNOWLEDGE THAT YOU ARE WAIVING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
- Small Claims Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the jurisdictional limits of the small claims court, provided the action is not transferred, consolidated, or joined with any other proceeding.
- Opt-Out. You may opt out of this arbitration agreement by sending written notice to us via our contact page within thirty (30) days of first accepting these Terms. If you opt out, neither party shall be bound by this arbitration provision, and disputes shall be resolved as set forth in Section 17 (Governing Law).
17. Governing Law
These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you and ScanYum consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware for the resolution of any disputes.
18. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will:
- Update the "Last updated" date at the top of this page;
- Provide notice of the changes through the App, by email, or by other reasonable means.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of and agreement to the updated Terms. If you do not agree to the revised Terms, you must stop using the Service immediately.
19. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect, and the invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
20. Service Modifications & Updates
We reserve the right to modify, update, or discontinue any part of the Service at any time, including adding, changing, or removing features, functionalities, or Scan Modes. Such modifications may be made for reasons including, but not limited to, improving performance, addressing security concerns, complying with legal requirements, or enhancing the user experience.
- We will endeavor to provide reasonable advance notice of material changes that may significantly and negatively affect your access to or use of the Service, through in-app notifications, email, or other appropriate means.
- Minor updates, bug fixes, and security patches may be deployed without prior notice.
- If a material modification to the Service has a substantial negative impact on your use of the Service, you may terminate your Subscription and stop using the Service. If you are an active subscriber at the time of such modification, you may be entitled to a pro-rata refund for the unused portion of your current billing period, subject to the refund policies of the Apple App Store.
- Your continued use of the Service after any modification constitutes your acceptance of the modified Service.
21. International Users & Consumer Rights
The Service is available to users worldwide, subject to applicable laws and regulations. Nothing in these Terms shall limit or exclude any mandatory consumer protection rights that apply to you under the laws of your country or region of residence.
- European Union / European Economic Area (EU/EEA). If you are a consumer residing in the EU/EEA:
- You may have a fourteen (14) day right of withdrawal from the date of purchase of a digital content Subscription. By starting to use the Service immediately upon purchase, you expressly consent to the provision of digital content before the expiry of the withdrawal period and acknowledge that you thereby forfeit your right of withdrawal, to the extent permitted by applicable law.
- Nothing in these Terms affects your statutory rights under the Consumer Rights Directive (2011/83/EU), the Digital Content Directive (EU 2019/770), or any national implementing legislation, including rights regarding the conformity of digital content and services.
- If we make a material change to the Service that negatively affects your access or use, you may be entitled to terminate your Subscription and receive a proportional refund, as required by applicable law.
- Other Jurisdictions. If mandatory consumer protection laws in your jurisdiction provide you with rights that cannot be waived or limited by contract, those rights shall prevail to the extent of any conflict with these Terms.
- Dispute Resolution for EU Consumers. EU consumers may also refer disputes to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
22. Apple App Store Provisions
The following additional terms apply to the extent that you downloaded the App from the Apple App Store and are using the App on an iOS device. These provisions are required by Apple and shall take precedence over any conflicting terms in these Terms of Service with respect to the matters addressed herein:
- Acknowledgment. You and ScanYum acknowledge that these Terms are entered into between you and ScanYum only, and not with Apple Inc. ("Apple"). ScanYum, not Apple, is solely responsible for the App and its content.
- Scope of License. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and Support. ScanYum is solely responsible for providing maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty. ScanYum is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- Product Claims. ScanYum, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Claims. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, ScanYum, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance. You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary. You and ScanYum acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
23. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by ScanYum on the Service, constitute the entire agreement between you and ScanYum concerning the Service. These Terms supersede all prior or contemporaneous communications, proposals, and representations, whether oral or written, between you and ScanYum with respect to the Service.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by ScanYum to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
